NEW YORK SUPPORT GUIDELINES
How New York Child Support Is Calculated
The Child Support Standards Act uses a percentage of combined parental income: 17% for one child, 25% for two, 29% for three, 31% for four, and at least 35% for five or more. Since March 1, 2026 the percentages apply to the first $193,000 of combined income, and courts may also apply them above that amount. Each parent pays a share in proportion to their income.
New York's income measure is unusual. It starts from gross income and subtracts FICA taxes and any New York City or Yonkers income tax actually paid, but not federal or New York State income tax, so it runs higher than take-home pay. Low earners are protected by a self-support reserve of $21,546 and a poverty level of $15,960 in 2026. This calculator starts from the amount in your order rather than setting one.
THE PERCENTAGES IN ONE EXAMPLE
New York Child Support Percentages on a $75,000 Income
Suppose you earn $75,000 and the other parent earns $50,000, both outside New York City. After FICA, your incomes are $69,263 and $46,175, so combined parental income is $115,438 and your share is 60%.
| Children | Percentage | Combined obligation / year | Your share / month | Your share / bi-weekly |
|---|---|---|---|---|
| 1 | 17% | $19,624 | $981 | $452.87 |
| 2 | 25% | $28,859 | $1,443 | $665.99 |
| 3 | 29% | $33,477 | $1,674 | $772.54 |
| 4 | 31% | $35,786 | $1,789 | $825.82 |
| 5+ | 35% | $40,403 | $2,020 | $932.38 |
If both parents lived in New York City, city income tax would also come off income. Using this calculator's withholding estimate for that tax, one child's share would fall from $981 to about $944 a month.
PAYROLL WITHHOLDING
How Child Support Comes Out of Your New York Paycheck
Support is withheld after taxes. Federal income tax, Social Security, Medicare, and any state and local income tax are figured on your full gross pay; the support deduction comes out of what is left.
An order usually reaches your employer as an income execution under CPLR 5241 or an income deduction order under CPLR 5242. Your employer must begin deductions no later than the first pay period that occurs 14 days after service, and must send each payment to the state disbursement unit within 7 business days of your payday.
CPLR 5241(g) writes the limits into New York law. Withholding cannot exceed 50% of disposable earnings if you currently support another spouse or dependent child, or 60% if you do not, rising to 55% and 65% when arrears go back more than twelve weeks.
STEP BY STEP
How Payroll Figures a New York Child Support Deduction
The same steps the New York paycheck calculator with child support follows, using a $75,000 salary paid bi-weekly and an $800 monthly order:
- Gross pay per check: $2,884.62.
- Subtract taxes required by law — federal $295.00, Social Security and Medicare $220.67, New York $134.07, PFL $12.46 — to get disposable earnings of $2,222.41.
- Apply the New York limit: 60% of disposable earnings is $1,333.45.
- Convert the order to this pay schedule: $800 × 12 ÷ 26 = $369.23.
- The order is under the limit, so $369.23 is withheld and $1,853.18 is paid to you.
DISPOSABLE EARNINGS
What Counts as Disposable Earnings in New York
Disposable earnings are gross pay minus deductions required by law. Voluntary deductions stay in the base, so a large 401(k) contribution does not lower the New York limit.
| Deduction | Subtracted? | Why |
|---|---|---|
| Federal income tax | Yes | Required by law |
| Social Security and Medicare | Yes | Required by law |
| New York income tax | Yes | Required by law |
| New York Paid Family Leave | Yes | State payroll program, counted as required here |
| New York City income tax | Yes, if a resident | Required by law |
| 401(k) contributions | No | Voluntary |
| Health insurance premiums | No | Voluntary, unless ordered |

TIMING AND BONUSES
When New York Withholding Starts and What It Covers
- Start date: no later than the first pay period that occurs 14 days after the employer is served.
- Payment: within 7 business days of your payday, sent to the state disbursement unit.
- Covered pay: CPLR 5241 counts wages, salaries, commissions, bonuses and lump sum payments as income.
- Limits: the percentage caps apply to compensation for personal services, measured on disposable earnings after required deductions.
CHANGES
Changing Jobs or Pay With a New York Support Order
Employers report new hires to the state, and the New York State Division of Child Support Services uses those reports to send the withholding notice to your new employer. Until the first deduction appears on a new pay stub, you remain responsible for paying the State Disbursement Unit directly, so a job change does not pause the order.
- A pay cut does not change the ordered amount; only a court or the agency can modify it.
- Ask for a review as soon as income drops — modifications usually apply from the filing date forward.
- Bonuses and commissions can be withheld too if the notice covers them; check the notice wording.
- Keep pay stubs showing each deduction as proof of payment.

COMMON QUESTIONS
New York child support Paycheck Questions
How much can be taken from a New York paycheck for child support?+
Under CPLR 5241(g), up to 50% of disposable earnings if you support another spouse or dependent child, or 60% if you do not. Those limits rise to 55% and 65% when arrears are more than twelve weeks old. Disposable earnings are what remain after amounts required by law.
How is child support calculated in New York?+
With the Child Support Standards Act: 17% of combined parental income for one child, 25% for two, 29% for three, 31% for four and at least 35% for five or more, split by each parent's share of income. In the example above, a parent earning $75,000 pays about $981 a month for one child.
Why does New York child support use income before federal and state tax?+
The statute's deduction list covers FICA and New York City or Yonkers income tax actually paid, along with items such as support for other children, and leaves federal and New York State income tax out. So a guideline amount based on gross pay can feel high next to your take-home pay.
What is the New York child support income cap in 2026?+
$193,000 of combined parental income, effective March 1, 2026. The cap is indexed every two years under Social Services Law 111-i. Above it, a court may apply the same percentages or use other statutory factors, so high-income orders can exceed the capped figure.
Are bonuses and commissions subject to New York child support withholding?+
Yes. CPLR 5241 defines income to include wages, salaries, commissions and bonuses, as well as lump sum payments. The same percentage limits on disposable earnings apply when the payment is compensation for personal services, so a bonus check can have support taken from it too.
